Wealth Planning

Estate planning – also known as wealth planning – focuses on the steps necessary to properly manage and pass on an individual’s assets. This can involve tax, corporate, succession, family, and civil law. The purpose is to help individuals meet their goals as they protect and manage their assets.

Preparing an appropriate wealth plan allows individuals to organize how their assets and rights will be divided among spouses, mandatory heirs, and third parties. By determining this during the individual’s lifetime, the possibility of legal disputes following their death can be eliminated, or at least minimized. Proper estate planning also provides greater protection for the interests of more vulnerable heirs or those with partial or complete incapacity.

In certain cases, including, among other reasons, to diversify investments, it could be advantageous to use legal structures established outside Brazil. These can include private investment companies (PICs), trusts, and other alternatives.

Our wealth planning team works in a multidisciplinary way, providing a variety of services. These include:

❯   Analyzing family and asset structure as the basis for appropriate wealth planning;

❯   Incorporating companies (such as holding companies) in Brazil or abroad for better asset structuring;

❯  Successions, including the preparation and review of wills and the carrying out of judicial and extrajudicial inventories;

❯   Preparing documents for gifts, with or without retained use rights, or with clauses preventing sale, encumbrance, or mixing with communal property, or providing for the reversion of either the asset given as a gift or its fruits;

❯   Preparing agreements that establish rules for the family to observe;

❯   Preparing prenuptial agreements or agreements governing existing relationships (marriage or domestic partnerships);

❯   Mediating family conflicts to implement the desired plan;

❯   Evaluating and planning for possible estate effects of marriage dissolution;

❯   Preparing shareholder/partner agreements;

❯   Preparing rules for succession and their implementation in companies incorporated outside of Brazil;

❯   Establishing investment funds.

We base our work on the family’s values, the business’s profile, and the family’s needs and goals. We always maintain strict confidentiality.
